ยินดีต้อนรับสู่ The Happiness เงื่อนไขการใช้บริการฉบับนี้ ("เงื่อนไข") เป็นข้อตกลงระหว่างท่าน ("ผู้ใช้บริการ") กับ บริษัท เดอะ ฮาปปี้เนส คอร์ปอเรชั่น จำกัด ("บริษัท", "เรา") การเข้าถึงหรือใช้งานเว็บไซต์ แอปพลิเคชัน และบริการใด ๆ ของเรา ถือว่าท่านได้อ่าน เข้าใจ และยอมรับเงื่อนไขนี้แล้วทุกประการ หากท่านไม่ยอมรับ โปรดยุติการใช้บริการ
1. คำนิยาม
- "บริการ" หมายถึง แพลตฟอร์มเครือข่าย (MLM) ตลาดกลางซื้อขายสินค้า ระบบสมาชิก ระบบคะแนน (PV) และฟีเจอร์อื่น ๆ ที่บริษัทให้บริการ
- "สมาชิก" หมายถึง ผู้ที่ลงทะเบียนเข้าร่วมเครือข่ายและใช้บริการของบริษัท
- "เนื้อหา" หมายถึง ข้อความ รูปภาพ สินค้า และข้อมูลทั้งหมดที่ปรากฏบนบริการ
2. คุณสมบัติของผู้ใช้บริการ
ท่านต้องมีอายุครบ 20 ปีบริบูรณ์ หรือบรรลุนิติภาวะตามกฎหมาย และมีความสามารถในการทำนิติกรรมได้โดยสมบูรณ์ ท่านรับรองว่าข้อมูลที่ให้ไว้ถูกต้อง เป็นความจริง และเป็นปัจจุบัน
3. การลงทะเบียนและบัญชีสมาชิก
- ท่านมีหน้าที่รักษาความลับของข้อมูลบัญชีและรหัสผ่าน
- ท่านต้องรับผิดชอบต่อกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของท่าน
- บริษัทขอสงวนสิทธิ์ในการระงับหรือยกเลิกบัญชีที่ฝ่าฝืนเงื่อนไข หรือมีพฤติกรรมฉ้อโกง
4. ระบบเครือข่าย คะแนน (PV) และผลตอบแทน
- การคำนวณคะแนน (PV) และผลตอบแทนเป็นไปตามแผนการตลาดและเงื่อนไขที่บริษัทประกาศ ณ ขณะนั้น
- บริษัทอาจปรับปรุงแผนการตลาด อัตราการจ่าย หรือเงื่อนไขผลตอบแทนได้ โดยจะแจ้งให้ทราบล่วงหน้าตามสมควร
- ผลตอบแทนขึ้นอยู่กับความพยายามและยอดขายจริง บริษัทไม่รับประกันรายได้ใด ๆ ทั้งสิ้น
- ห้ามแอบอ้าง โฆษณาเกินจริง หรือให้ข้อมูลอันเป็นเท็จเกี่ยวกับรายได้หรือผลิตภัณฑ์
5. ตลาดกลางและการซื้อขายสินค้า
- ผู้ขายต้องรับผิดชอบต่อคุณภาพ ความถูกต้องตามกฎหมาย และการจัดส่งสินค้าของตน
- บริษัทอาจตรวจสอบและอนุมัติรายการสินค้าก่อนเผยแพร่ และมีสิทธิ์นำสินค้าที่ไม่เหมาะสมออก
- ราคาสินค้า ค่าจัดส่ง และเงื่อนไขการคืนสินค้าเป็นไปตามที่ระบุในแต่ละรายการ
6. ข้อห้ามในการใช้บริการ
ท่านตกลงจะไม่กระทำการดังต่อไปนี้:
- ใช้บริการเพื่อวัตถุประสงค์ที่ผิดกฎหมาย ฉ้อโกง หรือหลอกลวง
- เผยแพร่เนื้อหาที่ละเมิดทรัพย์สินทางปัญญา หมิ่นประมาท หรือผิดศีลธรรม
- เจาะระบบ ดักจับข้อมูล หรือรบกวนการทำงานของบริการ
- สร้างบัญชีปลอม หรือปั่นยอดคะแนน/ยอดขายโดยทุจริต
7. ทรัพย์สินทางปัญญา
เครื่องหมายการค้า โลโก้ ซอฟต์แวร์ และเนื้อหาทั้งหมดบนบริการเป็นทรัพย์สินของบริษัทหรือผู้ให้สิทธิ์ ห้ามทำซ้ำ ดัดแปลง หรือนำไปใช้เชิงพาณิชย์โดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร
8. ข้อจำกัดความรับผิด
บริการจัดให้ "ตามสภาพที่เป็นอยู่" (as is) ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต บริษัทไม่รับผิดต่อความเสียหาย ทางอ้อม ความเสียหายสืบเนื่อง หรือการสูญเสียรายได้ที่เกิดจากการใช้หรือไม่สามารถใช้บริการได้
9. การระงับและยกเลิกบริการ
บริษัทขอสงวนสิทธิ์ในการแก้ไข ระงับ หรือยุติบริการบางส่วนหรือทั้งหมดได้ทุกเมื่อ รวมถึงระงับบัญชีที่ฝ่าฝืนเงื่อนไขนี้
10. การแก้ไขเงื่อนไข
บริษัทอาจปรับปรุงเงื่อนไขนี้เป็นครั้งคราว โดยจะประกาศฉบับปรับปรุงบนเว็บไซต์ การใช้บริการต่อไปหลังการปรับปรุงถือว่าท่านยอมรับเงื่อนไขฉบับใหม่
11. กฎหมายที่ใช้บังคับ
เงื่อนไขนี้อยู่ภายใต้บังคับและการตีความตามกฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทใด ๆ ให้อยู่ในเขตอำนาจของศาลไทย

Welcome to The Happiness. These Terms of Service ("Terms") form an agreement between you ("User") and The Happiness Corporation Co., Ltd. ("Company", "we", "us"). By accessing or using our website, application, or any of our services, you confirm that you have read, understood, and agree to these Terms in full. If you do not agree, please stop using the services.
1. Definitions
- "Services" means the network marketing (MLM) platform, marketplace, membership system, point value (PV) system, and other features provided by the Company.
- "Member" means a person who registers to join the network and use our Services.
- "Content" means all text, images, products, and information appearing on the Services.
2. Eligibility
You must be at least 20 years old or have reached the legal age of majority and have full legal capacity to enter into contracts. You represent that the information you provide is accurate, truthful, and current.
3. Registration & Accounts
- You are responsible for keeping your account credentials confidential.
- You are responsible for all activity that occurs under your account.
- We reserve the right to suspend or terminate accounts that breach these Terms or engage in fraud.
4. Network, Point Value (PV) & Rewards
- PV calculation and rewards follow the marketing plan and conditions announced by the Company at the relevant time.
- The Company may revise the marketing plan, pay-out rates, or reward conditions with reasonable prior notice.
- Rewards depend on actual effort and sales. The Company makes no guarantee of income whatsoever.
- Misrepresentation, exaggerated advertising, or false claims about income or products are prohibited.
5. Marketplace & Transactions
- Sellers are responsible for the quality, legality, and delivery of their products.
- The Company may review and approve listings before publication and may remove inappropriate items.
- Prices, shipping fees, and return conditions are as stated in each listing.
6. Prohibited Conduct
You agree not to:
- Use the Services for unlawful, fraudulent, or deceptive purposes.
- Publish content that infringes intellectual property, is defamatory, or is immoral.
- Hack, intercept data, or disrupt the operation of the Services.
- Create fake accounts or fraudulently inflate points/sales.
7. Intellectual Property
All trademarks, logos, software, and content on the Services are the property of the Company or its licensors. Reproduction, modification, or commercial use without prior written permission is prohibited.
8. Limitation of Liability
The Services are provided "as is". To the maximum extent permitted by law, the Company is not liable for indirect, consequential, or loss-of-income damages arising from the use of or inability to use the Services.
9. Suspension & Termination
The Company reserves the right to modify, suspend, or discontinue all or part of the Services at any time, and to suspend accounts that breach these Terms.
10. Changes to These Terms
The Company may update these Terms from time to time and will post the revised version on the website. Continued use after an update constitutes acceptance of the new Terms.
11. Governing Law
These Terms are governed by and construed under the laws of the Kingdom of Thailand. Any disputes shall be subject to the jurisdiction of the Thai courts.
